ON 14 OCTOBER KFC HAVE NOW INVOLVED THEIR LAWYERS ADAMS & ADAMS WHO HAVE SENT US A LETTER WHICH STATES THAT WE ARE HARASSING THEIR EMPLOYEES, AND THAT WE HAVE MADE DEFAMATORY STATEMENTS ABOUT KFC. ADAMS & ADAMS HAVE GIVEN US 5 DAYS TO REMOVE ALL OUR POSTS, BUT KFC AND ADAMS & ADAMS HAVE STILL NOT RESPONDED FROM 18 SEPTEMBER AS TO WHY THERE ARE SO MANY SIMILARITIES WITH THEIR COMPETITION AND OURS, NOR HAVE THEY PROVIDED ANY PROOF THAT WHAT WE HAVE STATED BELOW IS INCORRECT.

AS OF 09 OCTOBER 2020, KFC HAVE NOT RESPONDED TO OUR E-MAIL, AND THEY HAVE ALSO REMOVED THE CONTENTS FROM THEIR HACK-A-PRENEUR WEBSITE, AND DELETED THEIR POST ON TWITTER WHERE THEY ANNOUNCED THE WINNERS OF THE COMPETITION.

 

It seems big businesses have run out of original ideas, and have now resorted to stealing creative content from smaller companies and individuals.

In the last few months I've seen a rise in creatives taking to social media to complain about people, and large organizations who are stealing their intellectual property.

Now there will be 'learned' people who will say, whatever is meant for you will be yours, and there will be people who will not understand 'what the big deal is.'

The big deal is that creatives work hard even if it's 'just a post' on Instagram or 'just a picture' they took.

That end product that you see of 'just a picture' was created from an idea that they had in their mind, which took some time for them to think of.

Then they try to recreate what they had in their mind, to reality - which takes more of their time.

They usually don't just take one picture and it's over.
Creatives take many pictures - at different angles, with different lighting techniques, and maybe even at different times of the day.

Then in most cases the picture needs to edited, which again can take hours of their time to get right.

When someone goes to work everyday at their 9 to 5, gets paid their salary at the end of the month, and they go out and buy a car, pay for it every month, only for someone to come by and steal that car - it's a big deal.

It's a big deal because they worked so hard for it, they paid a lot for the car, and it's their property.

But a creative works all those long hours (which I explained above), sometimes doesn't even get paid for those hours, and then someone comes along and uses their picture without their permission or even giving them credit for it - but it is their property.

It might not be tangible like a car, but in most cases it appreciates more than the car ever will. society says this is not a big deal.

But society will say 'it's not a big deal, it's just one picture, we all take pictures and if it's online or on social media, it's free for anyone to use.'

That's like saying if someone just takes your car for a drive and never returns it, it's okay because it's on this earth and anyone is free to use it.

In August 2020 KFC ran a Competition for Entrepreneurs called Hack-a-preneur BUT the idea of the Competition was from iloveza.com's After Fajr Grind Awards.

KFC Hacked-an-Entrepreneur, well two from iloveza.com and another one named Justin Wu.

Let's start at the beginning. The term Hackapreneur was not coined by KFC nor were they given permission to use.

According to Justin Wu who coined the word more than 8 years ago and who uses it as his Instagram and Twitter handles @hackapreneur he did not give KFC permission to use the term in their campaign.

Below is all the Competition Details from KFC's website, with a comparison between iloveza.com's Competition on their website.

7. KFC asked their top 10 to submit a video on social media

iloveza.com had a bonus video entry as an option for participants which was published on social media during the public voting process, to help increase their votes.

8. KFC said they want to celebrate entrepreneurs in South Africa.

iloveza.com said they want to celebrate SMMEs around South Africa. iloveza.com also used this is as part of their announcement on social media:

11. KFC announced their winners on 25 September, but they failed to mention on the Competition website the date that the announcement would take place.

12. KFC announced the competition on the 04 August 2020 and the website for the Competition was published on 26 August 2020.

13. Everything on iloveza.com's website is copyright protected - it says so at the bottom of their website.

KFC doesn't have a copyright logo on their Competition website.....

At the time of publishing this article KFC Hackapreneur have not responded to an email sent to them on 18 September nor has KFC responded to any of the posts that iloveza.com has tagged them in on Twitter, Facebook, Instagram and LinkedIn.

The CEO of Yum Brands David Gibbs and CEO of KFC Tony Lowings have also not responded to the emails which I have sent to them. Both David Gibbs, Tony Lowings and Marketing Director of KFC South Africa, Suhayl Limbada have also not responded to the post their were tagged in by myself on LinkedIn.

A copy of your South African identity document or valid passport

Proof of your bank account details, that is not older than 3 months

High quality photo of you and your business

Name of your business and a summary of what it’s about e.g. a business profile or business plan

Written confirmation that you are the owner of the business, that the information contained in the pitch is original, that no other party has any rights to it, and that you have obtained all required consents and permits to enable you to submit the pitch as your own intellectual property e.g. CIPC registration

Answer the qualifying question: How has your business adjusted to challenges during COVID-19 Lockdown or How have you innovated around COVID-19 Lockdown?

Step 2

A panel of judges will select the top 10 Hack-A-Preneur.

Step 3

The top 10 Hack-A-Preneur will be required to do an elevator pitch of their business by posting a 30 sec video on social media.

The top 3 Hack-A-Preneur with the most votes will be invited to pitch their business to a panel of judges.

Step 5

The panel of judges select a winner - the Ultimate Hack-A-Preneur (1st place), runner up (2nd place) and 3rd place winner.

Who can enter the competition?

Pretty much anyone. As long as you're aged 18 years or older and younger than 35. The applicant needs to be a South African citizen or a foreign national who is a permanent resident and who is in possession of a valid identity document/ passport/ valid legal permit.

How do I enter the competition?

What’s the Offer?

5. Competition Terms and Conditions

Competition Rules: KFC Hack-A-Preneur Competition (“Competition”)

By entering this Competition and/or accepting any prize, all participants, entrants and winners agree to be bound by the terms and conditions below applicable to this Competition (“Rules”) and the Promotional Competition Rules (“ General Promotional Competition Rules”) applicable to promotional competitions run by KFC Proprietary Limited and/or its agencies (collectively, the “Organisers”) from time to time, which General Promotional Competition Rules shall be read together with these Rules.

Copies of these Rules and the General Promotional Competition Rules are available online at www.kfc.co.za (“Website ”) Capitalised terms in these Rules (unless otherwise defined) shall bear the meanings given to them in the General Promotional Competition Rules.

In the event of a conflict between these Rules and the General Promotional Competition Rules, these Rules will take precedence to the extent of such conflict.

Competition Period

The Competition will begin at 00:01 on 31st of August 2020 and will end at 23:59 on 18th September 2020 (“Competition Period”). No late entries will be accepted after the Competition Period.

Eligible Entrant’s

The entrant’s must meet the following minimum criteria to be eligible to participate in the Competition:

be a South African citizen or a foreign national who is a permanent resident and who is in possession of a valid identity document/ passport/ valid legal permit;

at the time of entering the Competition be over the age of 18 (eighteen) years but 35 (thirty-five) years or younger.

Must be an individual (i.e not part of a group or be a juristic person)

Must have started or elevated a business during the lockdown period (i.e between April 2020 and August 2020) and the business must be in operation for a minimum of 4 months.

Must Embody the values of a “hack-a-preneur” which means inter alia, hacked through lockdown, the idea must be genius, strong, innovative and have the potential for longevity (the criteria will be determined at the sole and unfettered discretion of the judges as well as the level of success thereof).

Persons who are excluded from entering the Competition include any director, member, partner, employee, agent of, or consultant (“Associates”) of the Promoters and/or KFC, or any other person who directly or indirectly controls, is employed by or is controlled by the Promoters, and/or immediate family members of Associates, who are indirectly or directly connected to or employed by any party in the aforementioned capacities or relationships, their advertising agencies, manufacturers, or distributors (“Disqualified Persons”).

each entrant represents and warrants that by entering in or participating in this Competition, he/she has ensured full eligibility to do so. The Organisers reserve the right to request proof that entrants have met these eligibility requirements.

How to Participate

Entry into the competition

To enter the Competition, entrants will be required to email a profile of their business as described in clause 2.4 above to: ZA_KFCHackapreneur@yum.com . The submission must include the following:

Your personal and business details;

A summary of what your business is all about;

Answer the qualifying question: How has your business adjusted to challenges during COVID-19 Lockdown or How have you innovated around COVID-19 Lockdown?

Only 1 (one) submission and one business per entrant will be permitted.

Entries on any other platform will not be eligible for the Competition.

With your submission you must provide:

Written confirmation that you are the owner of the business, that the information contained in the pitch is original, that no other party has any rights to it, and that you have obtained all required consents and permits to enable you to submit the pitch as your own intellectual property;

Written warranty that the submission does not include content: which infringes upon the rights of any third party including, without limitation, intellectual property rights, privacy, publicity or any other personal or proprietary right; that is deceptive or fraudulent; which promotes conduct that is reckless, unlawful or places the health and safety of others in danger.

FAILURE TO COMPLY WITH ANY ONE OF THE REQUIREMENTS ABOVE WILL RESULT IN AUTOMATIC DISQUALIFICATION.

Prize

4.1 There are a total of 3 (three) prizes which stand to be won in the Competition:

1st prize winner will receive R50 000 (fifty thousand rand);

The first runner up will receive R30 000 (thirty thousand rand); and

the 2nd runner up will receive R20 000 (twenty thousand rand).

All prizes also include a feature on The Throne – an online publication profiling the entrepreneur & their business, a one-on-one, up to one-hour mentoring session with a mentor chosen by KFC.

4.2 There may be tax implications regarding the cash prizes. The successful participants are responsible for obtaining independent tax advice. KFC shall not be responsible for any tax obligations arising from participation in the Competition.

Winner Selection

All valid entries will be reviewed by an evaluation committee, which will consist of a panel of four judges selected by KFC, and the Promoters.

The judges will select the winners based on inter alia, the following criteria:

the business model,

validity and uniqueness of the business,

strategic direction of the business, product/service offered,

the vision for the business,

the impact the business has made,

opportunity in the market,

the entrepreneur’s delivery of pitch,

financial need, and

the entrepreneur’s alignment with KFC’s tonality and ethics.

The judges’ decision shall be final.

The top 10 will be announced within 3 (three) working days from the end of the Competition.

Top 10 Hack-A-Preneurs do an elevator pitch of their business via video on social media. The public to vote for their the top 3 Hack-A-Preneurs.

Possible prize winners will be contacted by the Promoters via the email address provided by the entrant on the Competition website.

The top 3 Hack-A-Preneurs chosen do another video pitch to the panel of judges. The panel of judges decide on the top-3 ultimate Hack-A-Preneur (1st place), runner up (2 nd place) and 3rd place winner.

Possible prize winners will be required to participate in an audit verification process (which includes but is not limited to providing their proof of engagement with the competition in accordance with the entry mechanics), and will provide a copy of their Identity Document/Proof of Residence, banking confirmation letter and memorandum of incorporation. The audit verification process may also include an audit of your financial statements to ensure they are in satisfactory order as well as a compliance and integrity check.

6. Prize Award and Redemption:

Once the verification process has been successfully completed, the winners will be declared and notified via the email address provided during the entry application process. Declared and verified winners will be contacted by the Promoters to facilitate redemption of their Prize into their South African bank account within 15 (fifteen) working days from the end of the Competition Duration. If the Promoters are unable to make successful contact with the winner via the email address provided, to complete the audit verification, they will continue to send messages via the said email address for 72 (seventy two) hours where after the potential winner will be deemed to have forfeited the respective prize and a replacement/ substitute winner will be selected in the same manner as the first.

7. Usage Rights and Media:

7.1. Winners’ names may be published on the Promoters social media sites. The Promoters may request the winner to be identified and photographed and to have the photographs published in various media, including but not limited to print, online and web-based media, or to appear on radio and television, when accepting their prizes, as well as after having received their prizes or for the Promoters’ marketing material in so far as it relates to the Competition. No fee will be payable. All intellectual property in the images or Competition footage shall vest in KFC. All participants are deemed to have read and understood the terms and conditions of applicable social media sites, Promoters’ website, and of Participant’s mobile network service provider.

General terms

Without detracting in any way from the provisions contained in the General Promotional Competition Rules (except where there is a conflict, in which case these Rules shall take precedence) and the further provisions contained in these Rules above, the following general provisions shall be applicable to these Rules.

The promoter/s of this Competition are the Organisers. The Organisers will interpret the Rules in their sole discretion subject to the Consumer Protection Act and reserve the right to amend the Rules at any time in accordance with the provisions contained in these Rules.

ADDITIONAL TO ANY OTHER RIGHTS CONTAINED IN THE GENERAL PROMOTIONAL COMPETITION RULES, THE ORGANISERS RESERVE THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT DUE TO EVENTS BEYOND ITS CONTROL. IF THIS IS THE CASE, THE ORGANISERS WILL PROVIDE A NOTICE ON THE WEBSITE AND IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO REVIEW SUCH WEBSITE IN THIS RESPECT. The AFG Awards is only open for entries to South African residents.

You must enter on the entry form HERE

Entrants give consent for their details and answers to be published on iloveza.com's website and social media

The public will vote for their favourite businesses from Saturday 1 August 2020 at 00:01 until Monday 31 August 2020 at 23:59.

iloveza.com and the judges will choose the finalists and announce them by the 15 September 2020.

The Finalists will be announced on social media on 15 September 2020.

The Winners will be announced at a digital awards ceremony on 24 September 2020

The judge's decision is final.
